Terms of Service

1. Acceptance of Terms

By accessing or using OnboardZero (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, you may not use the Service. You must be at least 18 years old and have the authority to bind your company to these terms.

These terms govern your company's use of OnboardZero as an HR platform. They do not govern the relationship between your company and your employees — that remains your responsibility as the data controller.

2. Description of Service

OnboardZero provides a digital onboarding platform that enables HR teams to:

  • Send invite links to contractors and employees
  • Collect personal, banking, and tax information via secure online forms
  • Store submitted data encrypted in a GDPR-compliant EU database
  • Optionally sync employee records to Personio automatically

The Service is provided on a subscription basis. Features may change over time. We will provide reasonable notice of material changes.

3. Account Registration

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account.

Each account is associated with a single company. You may not share account access with other organisations or use the Service on behalf of third parties without our written consent.

4. Subscription and Billing

Subscriptions are billed monthly in advance via Stripe. Pricing is as shown on our pricing page at the time of sign-up. We reserve the right to change pricing with 30 days' written notice.

  • Subscriptions renew automatically unless cancelled before the renewal date
  • You may cancel at any time via the billing portal in your dashboard
  • No refunds are issued for partial billing periods
  • Past-due accounts may be suspended after 7 days

5. Acceptable Use

You agree not to use the Service to:

  • Collect employee personal data without a valid legal basis under GDPR
  • Send unsolicited onboarding invites to individuals without their employer's authorisation
  • Attempt to bypass rate limits, security controls, or access other customers' data
  • Reverse-engineer, scrape, or reproduce any part of the platform
  • Violate any applicable law, including Dutch labour law (Arbeidsrecht) and the AVG

As the data controller for your employees' data, you are solely responsible for ensuring you have a lawful basis to collect and process that data using OnboardZero.

6. Intellectual Property

OnboardZero and its underlying technology, design, and code remain the intellectual property of [YOUR COMPANY NAME] B.V. All rights reserved.

You retain ownership of all data submitted through the Service by your employees. You grant OnboardZero a limited licence to store, process, and transmit that data solely to provide the Service.

7. Limitation of Liability

The Service is provided on an "as-is" basis, particularly during the early access period. To the fullest extent permitted by Dutch law, OnboardZero is not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the Service.

Our total liability for any claim arising from these terms shall not exceed the total fees paid by you in the three (3) months preceding the claim.

8. Termination

Either party may terminate the subscription at any time. OnboardZero may suspend or terminate your account immediately if you violate these terms or engage in abusive behaviour toward the platform or other users.

Upon termination, you will have a 30-day window to export your data. After 30 days, all employee data associated with your account will be permanently and irreversibly deleted.

9. Governing Law

These Terms of Service are governed by the laws of the Netherlands. Any disputes arising from or related to these terms shall be submitted exclusively to the competent court in Amsterdam, the Netherlands.

If any provision of these terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
